Interpretation

These Terms and Conditions will be interpreted according to English Law.

Definitions

  • "Agreement" refers to the agreement between You and Us incorporating these terms and conditions for supplying the Service.
  • "Browser" refers to general visitors of the site who have not signed up for full membership.
  • "Content" refers to text, graphics, communications and or other information that is posted to the Site at any time.
  • "Intellectual Property Rights" means all database rights, copyright, design rights (whether registered or unregistered), patents, trade marks (whether registered or unregistered) and any similar rights wherever existing globally.
  • "Liability" means the liability of any kind for any damages, claims, proceedings, actions, awards, expenses, costs and any other losses and/or liabilities
  • "Member" means any person whose profile has been accepted by Us and has received membership confirmation.

Eligibility

You must be eighteen or over to use this Website. Membership of the Service is void where the terms and conditions have been breached. By using the site you represent and warrant that you have the authority, right and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

You warrant that you have not been convicted of any offence relating to violent and/or any offence under the Protection from Harassment Act 1997 (or any statutory enactment replacing and/or amending such Act).

We reserve the right to suspend or terminate your membership at any time if we believe such information is not a true and accurate statement.

Prohibited Activities / Violations / Non Commercial Use

Property Pact.co.uk reserves the right to investigate and terminate your membership if you have abused the service, or conducted Yourself in a way which could be considered inappropriate, illegal or unlawful.

To follow is a list of the type of activity that we will not tolerate with respect to the Service

  • -You will not suggest or express that any statements made by you are affirmed by Property Pact.co.uk without our specific prior written consent.
  • -You will not reproduce or distribute any intellectual property, copyrighted material, proprietary information or trademarks without obtaining the prior written consent of Property Pact.co.uk
  • -You will not remove or delete any copyright, trademark or other proprietary rights notices contained within the Service.
  • -You will not use any robot/spider technology, site search/retrieval applications or other manual/automatic devises or procedures to retrieve, index, "data mine", or in any way reproduce or bypass the navigational framework or integrity of the contents of the Site.
  • -You will not post any material which is of a criminal nature, which could give rise to civil liability, or otherwise be contrary to the letter of the law or contravene the rights of any third party around the world.
  • -You will not transmit in any way, material that contains viruses or any other code, files or programs designed to damage, disrupt, restrict or destroy the functionality of any hardware or software or communications equipment.
  • -You will not forge headers or otherwise manipulate Our identity in order to conceal the origin of any data or information transmitted through the Service

The Website is for the sole use of our members and browsers; it is not intended to be used in conjunction with any commercial efforts. Organisations or companies of any kind may not create membership and should not use the Website for any other purpose. Illegal and/or unauthorised uses of the Website, including collating usernames and/or email addresses of our members by any means for the purpose of sending undesired email and unauthorised linking to or framing of the Website will be investigated, we will initiate legal action, including without limitation, criminal, civil, and injunctive compensation.

Content Criterion

You concur not to post, upload or transmit to the Site or our servers or send to any Members, any content that:

  • -will reveal your personal details, such as telephone numbers, fax number, email addresses, URL or any other information that would allow other Users to contact you henceforth;
  • -is deemed to be racially offensive, lewd, discourteous, derogatory, abusive, harmful, fraudulent, harassing, suggestive, inflammatory, threatening, defamatory or libellous;
  • -might offend the beliefs of others, be it political and/or religious;
  • -encourages or pertains to any illegal activity;
  • -contravenes, infringes, violates and/or is contrary to any law, by-law, statute and/or regulation or code of conduct or any other parties' rights (including but not limited to intellectual property rights and personal data protection rights);
  • -is deemed junk mail, spam, chain letters or any other form of unsolicited or undesired material of this nature;
  • -advertises on behalf of other websites, businesses or services in any way;
  • -abuses the service or any information posted on the site in any way.

Profile Screening

All profiles upon submission to Property Pact will be screened and proof read before publication to the Site. Should we find any content undesirable or contrary to our terms and conditions of content, the profile will be deleted and an 'access denied' email will be sent to you in response.

Account Security

You accept full responsibility for the continued confidentiality of your account, username and password, and you are fully responsible for all activities under your username and password.

You agree to

  • -Immediately notify Us of any breach of security
  • -Immediately notifying Us of any unauthorised use of your username or password
  • -Ensure that you log out of your account at the end of each session

Property Pact.co.uk will not accept liability for any loss or damage resulting from your non-compliance with this condition. Always exercise caution when accessing your account from public places or shared computers. If you share your computer with others, you may wish to consider disabling your auto-sign in functionality.

Term and Termination

This Agreement will remain while you are a member of the Service.

You may terminate your membership for any reason, at any time, effective upon receipt by us of your email notice of your wish to terminate. (link to notice of termination email).

Should you wish to terminate, your membership will remain active until the end of the current quarter. In case of violation of one or more of the terms of this Agreement by You we may disable your account(s), delete prohibited material and prevent posting of all or part of your profile. We may also block your access to all or part of the Service, either on a permanent or temporary basis.

Property Pact.co.uk reserves the right to deactivate the accounts of members who have not used the Service for a period of six months or more (calculated by the date of last connection to the Service).

We reserve the right to immediately terminate your membership and your access to the Service at any time. We will send you notice of termination to You at the email address held on our database.

You agree that We will not be liable to You or any third-party for termination of Your access to the Service.

Proprietary Rights of Content on PropertyPact.co.uk

Property Pact.co.uk Ltd retains and owns all proprietary rights. This site contains trademarks, copyrighted material and other proprietary information. Excluding information which is in the public forum or for which you have been granted permission, you are not permitted to copy, adjust, publish, transmit, distribute, display or sell any such proprietary information.

Changes/Modifications to the Site

We reserve the right at any time to change or cease the service or part of, either on a temporary or permanent basis, without notice to You. We will not be liable to you or to any third party for any change, adjournment or discontinuation of the Service.

  • -the use or the inability to use the service
  • -statements or information of any 3rd party on the site
  • -any other matter relating to the service

However this cannot be guaranteed and we reserve the right to change the information on this website (including the terms and conditions and privacy policy) at any time.
